Man agrees to plea in break-in case
A Prince George man accepted a plea agreement during Charles City Circuit Court proceedings last Friday.
Brian Stuart Miller, 35, of 15402 Pleasant Grove Drive, Disputanta, entered guilty pleas to one count each of attempted burglary and one count of destruction of property. One charge of misdemeanor entering to damage property was dropped.
In a summary of evidence provided by Commonwealth’s Attorney Rob Tyler, Miller attempted to break into the home of Lindsay Maple while she was at home. The defendant rang the doorbell several times but Maple elected not to answer. Maple than heard what sounded like an attempt to break into her home. When the defendant successfully broke a door to gain entry, he was greeted by Maple, who is a member of the military, wielding an AR-15 rifle. Miller panicked and fled the scene. Maple notified police and gave a description of the suspect and his vehicle. Miller was arrested shortly afterward.
Under the plea agreement, Miller received a six-month active sentence on the attempted burglary charge, with nine years, six months of the time suspended. All 12 months on the destruction of property charge was suspended. He must also pay restitution for damage to the door. Miller’s sentence is also above the sentencing guidelines due to facing similar charges in Hopewell and Prince George.
