New Kent man receives 17-year prison term for crimes against minor

A New Kent man will spend the next 17 years in prison for his involvement with child pornography and crimes against a minor after receiving his sentence following Monday afternoon proceedings in New Kent Circuit Court.

During his September trial, a summary of evidence presented by New Kent Commonwealth’s Attorney Scott Renick revealed that from June 2021 to Sept. 2022, the Internet Crime Task Force received a tip about the possible distribution of pornography of a minor. The investigation and information discovered a social media account sending images of minors between the age of 13-17. That information was relayed to an address in New Kent County, with New Kent Sheriff’s Office taking over the investigation. New Kent Sheriff’s Office developed Schaub as a suspect based on the account information and went to his residence with a search warrant. When officers showed the defendant the warrant and what they were looking for, he indicated all the information was on his cell phone and in his car. Schaub explained to officers that he used a social media application to share files and that he had shared upwards of 100 photos of minors. Schaub was arrested and taken into custody.

In June 2022, a victim went to New Kent Sheriff’s Office to report crimes committed against them when they were a minor. The crimes stemmed from 2014, when the victim said they were assaulted by Schaub, who was a family friend at the time. The victim indicated that they were sexually assaulted at least 20 times, with the defendant touching their private areas in various locations that included the defendant’s home, a car, and at church.

Schaub received a 40-year prison sentence with 33 years suspended on the using an object for sexual penetration conviction. He also received a 10-year sentence with five years suspended (five years to serve) on one count of reproducing child pornography (first offense), a 10-year sentence with five years suspended on the reproduction of child pornography (second or subsequent offense), and a 12-month sentence with all time suspended on the misdemeanor sexual assault of a child conviction.

In another case, two individuals who stole alcohol from an ABC store accepted plea deals, averting a jury trial that was scheduled for this week.

Demetrius Perry, 28, of the 1400 block of Goff Street, Norfolk, and Asia Jarvis, 31, of the 1400 block of Deep Creek Boulevard, Chesapeake, admitted to the crimes.

In a summary of evidence, on Jan. 19, a New Kent deputy responded to a call for service from the assistant manager of the ABC Store in Quinton. The manager showed the officer the security footage of two individuals in the store. The footage was able to identify Jarvis, and was later to connect Perry to the crime. Among the items taken were bottles of Hennessey, Dussey, Patron, and Don Julio. The store manager was also able to identify Jarvis as an individual who had entered the store on Sept. 18, 2022 and stole items on that day as well.

Jarvis pled guilty to one count each of grand larceny with intent to sell stolen property and one county of grand larceny. Three additional charges of grand larceny with intent to sell stolen property, robbery, conspiracy to commit robbery, and conspiracy to commit grand larceny were dropped as part of the deal. She received a 10-year sentence with eight years, six months suspended (one year, six months to serve) on the grand larceny conviction, while all ten years on the grand larceny with intent to sell stolen property were suspended.

Perry received a five-year sentence with all but three months suspended on the grand larceny with intent to sell stolen property conviction. An additional charge of robbery was dropped. Both defendants must pay $791 in restitution and have been banned from all Virginia ABC stores for at least 10 years.

A third suspect, Deshawn Jarvis, had one charge each of robbery, conspiracy to commit robbery, larceny with intent to sell stolen property, and conspiracy to sell stolen property dropped due to a lack of evidence.

In other circuit court proceedings:

–Bradford Weldon Boseman Jr., 29, of the 30000 block of Oakdale Road, Waverly, entered guilty pleas to one count each of assault on a law enforcement officer and misdemeanor assault and battery of a family member as part of a plea deal. One charge of felony child abuse was dropped as part of the agreement.

In a summary of evidence, on July 22 Boseman entered a residence intoxicated and got into an altercation with a family member. During that altercation, they pushed the member, resulting in local authorities to respond. When a New Kent deputy tried to calm down the situation, Boseman kicked the officer. The officer warned the defendant not to kick him again or he would press charges and arrest him, Boseman did it again, resulting in his arrest.

Under the plea agreement, Boseman received a five-year sentence with four years, five months suspended (seven months to serve) on the assault of a law enforcement officer conviction. All 12 months on the misdemeanor assault and battery of a family member were suspended.

–William Derrick Flemming, 45, of the 3400 block of E. Marshall Street, Richmond, entered a guilty plea to an amended charge of misdemeanor carrying of a concealed weapon (originally possession of a weapon by a violent felon) as part of a plea deal.

In a summary of evidence, on May 2, a Virginia State Trooper noticed a van traveling on Eltham Road that had a flat tire and no front license plate. A traffic stop was executed and the driver, identified as Flemming, told the officer that the vehicle belonged to his boss. When the officer asked the van, the defendant consented, resulting in the discovery of a gun in the glove compartment.

Under the agreement, Flemming received a 90-day sentence with 86 days suspended (four days to serve). He must also pay a fine of $500.

–David Sidney Howell, 63, of the 5300 block of Roxbury Road, Providence Forge, pled guilty to one count of driving while being felony revoked after being convicted of three DUIs or more as part of a plea agreement.

In a summary of evidence, on May 10, 2022, a Virginia State Police officer noticed a gold Ford Taurus traveling northbound on Route 106 had an inspection sticker that looked fake. After executing a traffic stop, the trooper was able to verify the sticker was fake and approached Howell, who was the driver. Howell admitted to the officer that he did not have a license and it had been revoked to previous DUI convictions. Howell was arrested on the offense as he was not permitted to drive.

Under the agreement, Howell received a five-year sentence with all but 10 months suspended. He must also pay a fine of $500.

–Kiana Marie Sanders, 28, of the 1300 block of East Longview Drive, Woodbridge, entered pleas of guilt to one count each of felony eluding and felony child abuse as part of an agreement. An additional charge of misdemeanor reckless driving was dropped as part of the deal.

In a summary of evidence, on July 10, a New Kent deputy operating radar on Route 33 noticed a Silver Sedan with an inspection sticker from 2022. The officer conducted a traffic stop and approached the vehicle, identifying the driver as Sanders and also saw a small child sitting in the rear of the vehicle. When the officer informed Sanders the vehicle would have to be towed, she accelerated from the scene, traveling over 100 miles per hour. After running a red light at the intersection of Route 33 and Route 30, she continued onto Interstate 64 westbound, where her vehicle came to a halt due to a brush fire occurring and shutting down the road. Sanders was arrested and taken into custody.

Under the agreement, Sanders received a five-year sentence with four years, two months suspended on the felony child abuse conviction (10 months to serve). All five years on the felony eluding conviction were suspended, and she must pay a fine of $500.

–Crystal Rose Southers, 30, of the 6800 block of Woodpecker Road, Chesterfield, entered guilty pleas to one count each of possession of a Schedule I/II drug, felony eluding, and misdemeanor DUI (first offense) as part of an agreement. An additional charge of possession of a Schedule I/II drug was dropped as part of a plea agreement.

In a summary of evidence, on Mar. 18, a Virginia State Police trooper noticed a vehicle with an expired inspection sticker. After executing a traffic stop, the driver, identified as Southers, was asked about the sticker. The officer noticed slurred speech from the defendant, who fled the scene. A brief chase took place before the defendant wrecked the car. After Southers was placed into custody, a search of the vehicle revealed the discovery of some items with a white substance on it, later identified as methamphetamine.

Southers received a 10-year sentence with nine years, nine months suspended (three months to serve) on the possession of a Schedule I/II drug conviction. All five years on the felony eluding and all 12 months on the DUI (first offense) were suspended. She must also pay a fine of $500.

–Franklin Jose’ Cauec Xitumul, 22, of the 1600 block of Treehaven Drive, Richmond, failed to successfully complete the First Offender Program.

On June 10, 2022, Xitumul was pulled over during a traffic stop when a police officer noticed white powder in his vehicle. That substance turned out to be cocaine, which he admitted to during a Nov. 7, 2022 trial. He was placed in the First Offender Program but violated the terms and conditions of it.

Xitumul received a five-year sentence with four years, nine months suspended (three months to serve) on a possession of a Schedule I/II substance. A charge of felony violating the First Offender Program by drinking alcohol was dismissed.
