New Kent man receives two-year jail sentence for possession of child pornography

A New Kent man will spend two years in jail after entering no contest pleas to possession of child pornography.

Timothy Nathaniel Douglas, 34, entered a no contest plea to one count each of possession of child pornography and possession of child pornography (second offense) as part of a plea deal reached Monday afternoon in New Kent Circuit Court. Nine additional charges each of possession of child pornography and possession of child pornography (second offense), and one charge of possession of a Schedule I/II drug were dropped as part of a plea agreement. A no contest plea means that evidence presented in the trial would be enough to convict the defendant of the crime.

In a summary of evidence provided by New Kent Commonwealth Attorney Scott Renick, on May 17, 2021, local law enforcement received a tip about possible sexual exploitive material being disseminated through a Google profile account. Information received said that an account had uploaded possible pornographic material involving a minor. A local detective conducted a follow-up, discovering material of an underage male having sexual intercourse with an adult male. A subpoena was issued to Google, who provided information about the files, the email address, and IP number of the computer where this information was discovered. The subpoena yielded additional information of photos and videos of underage boys having sexual intercourse with men, with the IP address being located in New Kent. Email addresses were connected, leading to Douglas as the subject. He was arrested with a search of his computer discovering the inappropriate content on his computer.

Under the plea agreement, Douglas received a 10-year sentence with nine years suspended on the possession of child pornography (second offense) conviction. He also received a five-year sentence with four years suspended (one year to serve) on the possession of child pornography conviction, resulting in him serving a total of two years of active time in jail.

In other New Kent Circuit Court proceedings:

–Harlan Egan Adkins, 52, of the 4700 block of Adkins Road, Providence Forge, entered straight guilty pleas to one count each of assault and battery on a family member (third offense) and attempted strangulation. One additional charge of assault and battery on a family member was dropped.

In a summary of evidence, on Oct. 6, 2022, a New Kent deputy responded to a call for service related to a possible domestic dispute. The officer arrived to a residence on Riverside Drive, where the defendant, identified as Adkins, was house-sitting. Family members at the residence indicated that Adkins had made suicidal threats and they came to check on him. When they arrived, the defendant became irate with them, charging at one victim and knocking them over, while attempting to strangle another one. After receiving more statements, Adkins was arrested and taken into custody.

A presentence report is being prepared with sentencing guidelines recommending a range from 11 months to three years, three months to serve. Formal sentencing is tentatively scheduled for June 12.

–Jamal Kareem Brock, 50, of the 800 block of Oliver Hill Way, Richmond, entered a guilty plea to one count of uttering as part of a plea agreement.

In a summary of evidence, on Aug. 29, 2022, a New Kent Sheriff’s Officer responded to a call for service about the possibility of a fraudulent check being attempted to be cashed. When the officer arrived, Brock was attempting to cash a check in the amount of $4,329.66 from Martin Control Equipment. After an investigation, Brock was taken into custody as the check had not been given to the defendant from the company.

Under the agreement, Brock received a five-year sentence with three years, 364 days suspended (one year and one day to serve).

–Matthew Wayne Haynes, 52, of the 100 block of Plain View Lane, Shacklefords, entered guilty pleas to one count each of felony eluding of police, felony driving suspended after being convicted of a DUI, and misdemeanor DUI (second offense) as part of a plea deal. One count of carrying a gun while under the influence was dropped.

In a summary of evidence, on Nov. 29, 2022, a New Kent deputy traveling westbound on Interstate 64 noticed a vehicle swaying back and forth and unable to maintain control in their lane. When the officer attempted to conduct a traffic stop at the 218-mile marker, the vehicle did not pull over and began to take off. Other officers joined the pursuit, eventually using a rolling roadblock to bring the chase to an end. When the initial officer approached the vehicle, they detected a strong odor of alcohol. Haynes was identified as the driver and failed to pass any sobriety tests administered by the law enforcement officer. He was arrested, and his blood-alcohol content level returned as a .28, approximately three-and-a-half times the legal limit.

Under the agreement, Haynes received a five-year sentence with four years suspended (one year to serve) on the felony driving suspended after convicted of a DUI. He received a 12-month sentence with all but 40 days suspended on the misdemeanor DUI (second offense) charge, and all five years on the felony eluding of police charge were suspended. The one-year and 40 days to serve is mandatory time to serve under the state statute, and he must also pay a $1,000 fine.

–Alexander William Kessler, 25, of the 4400 block of Windy Lane, Barhamsville, entered a guilty plea as part of an arrangement with the Commonwealth Attorney.

In a summary of evidence, a New Kent deputy responded to a domestic dispute, with Kessler as one of the parties being involved in it. After detaining and placing the defendant in custody, a search was conducted, with a tube that contained a white powdery substance on it being discovered. A subsequent lab test resulted in the substance being cocaine.

Under the agreement, Kessler will be placed into the First Offender Program. If the defendant successfully completes the program, the charge will be dismissed.

–Czaar’Aquil T. Outlaw, 23, of the 6700 block of Kenny Lane, Portsmouth, entered guilty pleas to three counts of credit card larceny as part of a plea agreement. Seven additional counts of credit card larceny, and one count each of buy/selling a stolen credit card and pretrial failure to appear were dropped as part of the plea deal.

In a summary of evidence, on Dec. 17, 2021, a Virginia State Trooper conducted a traffic stop after noticing a vehicle driving recklessly. After the initial stop, the vehicle took off and fled the scene. After the vehicle came to a stop, the driver fled while the passenger, identified as Outlaw, remained with the vehicle. With probable cause, the officer searched Outlaw and the vehicle, discovering credit cards in a backpack that were not in his name nor the driver’s name. According to the defendant, they were on their way to meet someone to give the cards to and had used the cards for personal use.

A presentence report is being prepared on the defendant, with sentencing guidelines recommending a term of seven months to one year, four months to serve. Formal sentencing is scheduled for June 12.
