New Kent woman receives three months in jail after violating terms of First Offender Program
A New Kent woman has been formally found guilty of possession of a Schedule I/II substance after violating the terms of the First Offender Program.
Barbara Ann Toney, 49, of the 9800 block of Essex Hills Road, received the formal conviction as part of Monday proceedings in New Kent Circuit Court.
During a June 15 trial, Toney accepted the terms of a plea deal to the aforementioned drug possession charge and misdemeanor DWI (first offense). During that trial, evidence presented indicated that on Aug. 27, 2025, a New Kent deputy was dispatched to an incident on New Kent Highway about an individual showing signs of public intoxication. When the deputy arrived, they were approached by emergency personnel who were treating an individual, later identified as Toney. Emergency personnel told the officer that they discovered Toney behind the wheel of a running car that was on the side of the road. A K-9 unit arrived on scene and conducted a free air sniff, positively identifying drugs in the car. A search of Toney’s vehicle yielded the discovery of a glass pipe. The defendant admitted that she used the device to smoke crack cocaine.
Toney was placed in the First Offender Program to provide an opportunity for her to have the charge dismissed after the year-long probation. However, Toney violated the terms and received her formal conviction during Monday’s trial.
Toney received a five-year sentence with four years, nine months suspended (three months to serve). She was previously sentenced to 12 months with all time suspended on the misdemeanor DWI conviction and was fined $1,000 with $500 of that amount suspended.
In other circuit court proceedings:
–Tyler George Lyman Flannery, 24, of the 900 block of Glidewell Road, Richmond, entered guilty pleas to an amended charge of misdemeanor failure to report an accident (originally felony failure to stop at the scene of an accident) and misdemeanor reckless driving as part of an agreement.
In a brief summary of evidence, on June 23, Flannery was involved in a vehicle accident. Flannery drove away a short distance from the scene before stopping. Officers investigated the accident and determined Flannery caused it with his reckless driving.
Under the agreement, Flannery received a 12-month sentence with all but one month suspended on the failing to report an accident conviction. All 12 months on the reckless driving conviction were suspended.
–Fawn Leeann Morel, 43, of the 5400 block of Airport Road, Williamsburg, entered a guilty plea to an amended charge of misdemeanor bad check larceny (originally forging a bank note) as part of a plea agreement.
In a summary of evidence, on Nov. 19, 2025, Morel was part of a group of individuals who were being investigated for cashing bad checks at Lanexa Plaza. During the investigation, Morel was determined to be a suspect. When questioned, Morel admitted that she did indeed cash the false amounts and she had knowledge of the scheme.
Under the plea agreement, Morel received a 12-month sentence with nine months suspended (three months to serve).
–Allison Erica Weagley, 36, of the 13900 block of Cypress Drive, Lanexa, pled guilty to a single charge of possession of a Schedule I/II drug as part of a plea deal. In a summary of evidence, on Nov. 26, 2024, Weagley was found in possession of Fentanyl by a New Kent deputy.
A presentence report is being prepared on the defendant, with formal sentencing scheduled for Jan. 11, 2027.
