Judge rejects portion of plea agreement, sentences man to 30 months in prison
A Richmond man who accepted a plea deal during a Dec. 14 trial in New Kent will spend more time in prison after failing to qualify for the Detention and Diversion programs.
Dylan Matthew Hunt, 26, of the 500 block of Lafayette Avenue, was handed sentences on one felony charge each of DUI (third offense) and driving revoked (DUI related) during Feb. 8 proceedings in New Kent Circuit Court.
In the original plea agreement, Hunt received a five-year jail sentence with four years, nine months suspended (three months to serve). And while Judge B. Elliott Bondurant accepted that portion of the agreement, concerns about aspects of the offenses troubled him.
“I disapprove of the fact that this man was driving drunk at over 100 miles per hour on Interstate 64 with the driver’s side door open,” Bondurant commented, referring to the Aug. 11 incident. “I was hoping he would get accepted into the Detention and Diversion program to help him.
“But because he didn’t qualify, his record, and this type of speed, I just don’t feel comfortable with this part of the plea agreement,” the judge concluded.
Hunt was sentenced to five years in jail, with two years, six months suspended (two years, six months to serve). One year is the mandatory minimum to be served under state statute.
In an unrelated matter, a Williamsburg man accepted a plea deal to an amended charge in relation to a burglary that occurred in the county.
Ryan S. Quesenberry, 23, of the 200 block of Burton Drive, Williamsburg, entered a guilty plea to one count of misdemeanor being an accessory after the fact (originally grand larceny). One charge each of conspiracy to commit burglary, burglary, and active participation in a criminal gang during a criminal act were dropped.
In a summary of evidence, Quesenberry had a warrant for participating in crimes in New Kent. Quesenberry admitted he was in the area but did not actively participate in the offenses.
Under the plea agreement, he received a 12-month jail sentence with all time suspended, but will be placed on supervised probation for five years.
