Two reach agreements in New Kent Circuit Court
Two men in unrelated cases accepted plea agreements as part of May 16 New Kent Circuit Court proceedings.
Colton Jon Dearborn, 19, of the 17000 block of The Glebe Lane, Charles City, entered guilty pleas to two amended charges of misdemeanor accessory after the fact to possession of cocaine (originally possession of cocaine) and misdemeanor possession of drug paraphernalia (originally possession of heroin).
In a summary of evidence provided by Commonwealth’s Attorney Linwood Gregory, on Oct. 22, 2015, Dearborn was working at a local restaurant when his manager noticed erratic behavior and assumed he was under the influence of a substance. After notifying the sheriff’s department, a detective responded and questioned the defendant. Dearborn, who was dismissed from his job, told the officer his backpack remained in the restaurant. The detective retrieved the item and asked Dearborn for permission to look through it. After receiving consent, the officer discovered remnants on a canister and subsequently arrested the defendant.
Under the agreement, Dearborn received 12-month sentences on each charge. He will serve nine months in jail on the accessory conviction with three months suspended. All time was suspended on the possession of drug paraphernalia.
Luis Javier Quinones, 40, of the 2400 block of Homeview Drive, Richmond, entered an Alford plea of guilty (stipulating that while he maintains his innocence, evidence presented in the case would be enough to convict him) to an amended charge of trespassing (originally construction fraud). A charge of felony failure to appear was dismissed.
In a summary of evidence, on May 1, 2015, William Penny hired Quinones to construct a fence at his home. Quinones asked for a down payment of $800 to purchase materials to begin the job. The defendant never was able to obtain the materials to begin the work.
Under the agreement, he received a 12-month jail sentence with all time suspended. Quinones did pay $900 in restitution to Penny that included a payment of $100 for interest.
