Charles City man pleads guilty in New Kent Circuit Court to conspiring to sell cocaine

A Charles City man who conspired to sell cocaine to an associate from New Kent will spend nine months in jail.

Westmore Wilson Tabb III, 25, of the 8900 block of Little Elam Road, entered a guilty plea to a single count of conspiracy to sell a Schedule I/II substance as part of a plea agreement reached Monday during New Kent Circuit Court proceedings. One count of the aforementioned charge was dropped as part of the plea deal.

In a summary of evidence provided by New Kent Commonwealth Attorney Scott Renick, in Dec. 2019 a New Kent investigator obtained information about a potential drug sale that was going to take place. Using that information, the investigator was able to get information on the seller, later identified as Tabb. After receiving information and a confession from a New Kent co-defendant, a buy was set up in which Tabb called the co-defendant to initiate it. Because the call was received in New Kent, Tabb was charged with conspiracy after he was arrested in Charles City a couple of days later.

Under the plea agreement, Tabb received a 10-year jail sentence with nine years, three months suspended. He must also pay a $500 fine.

In an unrelated crime, a New Kent woman will enter into the first offender’s program after entering a guilty plea to one count of possession of a controlled substance.

Michala Rachel Simmons, 26, of the 5200 block of Hopewell Road, entered a guilty plea to one count of possession of a Schedule I/II substance (methamphetamine). One charge of misdemeanor violation of pretrial was dropped.

In a summary of evidence, on May 18 a law enforcement officer conducted a traffic stop. Upon conducting the stop, the officer conducted a lawful search of the vehicle and of Simmons. It was discovered that Simmons had methamphetamine on her without a valid subscription and was later taken into custody.

No formal finding was rendered as the defendant will entering into the First Offender Program. If she successfully completes the one-year program, the charge will be dismissed.
