King & Queen man receives no active time for trespassing on River’s Rest in Charles City

A King & Queen man will spend no active time incarcerated after accepting a plea deal Friday morning in Charles City Circuit Court.

Nathan Eugene Mercer, 40, of the 400 block of Bunker Hill Road, entered guilty pleas to an amended charge of trespassing (originally burglary), a second charge of misdemeanor trespassing, and misdemeanor assault and battery. One charge of possession of a weapon (not a firearm) by a convicted felon was dropped.

In a summary of evidence presented by Assistant Commonwealth Attorney Tyler Klink, on Feb. 18, Mercer went to the River’s Rest Marina in the eastern part of Charles City County to look for a relative who worked there. When he did not find that relative, he became upset, storming through an employees’ only door and confronting the manager at that time.

After the manager told him to leave, Mercer went outside and called out the manager for a physical confrontation. When the manager did not come outside, Mercer reentered the area once again and tried to engage in a fight. Mercer exited one more time before leaving the premises as the manager called for the police. Mercer was pulled over shortly afterwards and questioned about the incident before being taken into custody.

Under the agreement, while Klink lobbied for a six-month active sentence, Judge Charles Ricketts sentenced Mercer to 12 month sentences on each of the three misdemeanor convictions with all time suspended under the condition that he completes rehabilitation and mental health treatment programs during his time under the probation office’s supervision.
