Lanexa man receives two months in jail for kicking young relative in stomach
A Lanexa man who kicked a younger relative will spend the next two months in jail.
Joshua Bryan Lane, 46, entered a no contest plea to one count of misdemeanor assault and battery on a family member during Monday morning proceedings in New Kent Circuit Court. One count of felony child abuse was dropped. A no contest plea indicates that evidence presented in the case would be enough to convict the defendant of the crime.
In a summary of evidence presented by New Kent Commonwealth Attorney Scott Renick, on Nov. 25, 2022, the young victim told an older relative that Lane had kicked them in the stomach during a previous visit to the defendant’s house. The victim was taken to the hospital, where doctors determined that they had suffered a contusion to the inner wall of the stomach. When the older relative questioned Lane through a text message, Lane said that he was upset because the victim was playing on an electronic tablet and not with him.
Lane received a 12-month sentence with 10 months suspended (two months to serve) on the conviction.
In other circuit court proceedings:
–Talmadge Alvis Allen Sr., 71, of the 3500 block of Harris Avenue, Richmond, entered straight guilty pleas to one count each of possession of a Schedule I/II drug and misdemeanor false identification to a law enforcement officer.
In a summary of evidence, on Jan. 18, a New Kent deputy witnessed a passenger in a Ford pickup truck acting erratically while at the FasMart gas station in Bottoms Bridge. When information was run on the vehicle, it was discovered that the vehicle belonged to a man wanted out of Henrico County. The officer approached the passenger, who declined that he was the wanted man. The deputy showed a picture of the defendant with his name, leading to Allen’s confession. After the defendant was arrested, a search discovered three glass smoking devices and a folded napkin with a white powdery substance on it. The substance was sent to a forensics lab and came back as positive for cocaine. The defendant was then charged with the offense.
Allen received a three-year sentence with two years, 11 months suspended (one month to serve) on the possession of cocaine conviction. He received a 12-month sentence with 11 months suspended (one month to serve) on the misdemeanor false identification conviction.
–Derrick Devonte Dillard, 26, of the 7900 block of Simons Drive, Norfolk, pled guilty to an amended charge of misdemeanor possession of a concealed weapon (originally possession of a weapon by a violent felon) as part of a plea agreement.
In a summary of evidence, on Aug. 13, 2022, a New Kent Sheriff’s Officer pulled over a truck after noticing license plates not matching the proper vehicle. When the deputy approached the vehicle, an odor of marijuana was detected. The passenger, later identified as Dillard, admitted that he had less than a half-ounce of the substance on him. After the driver originally denied a search of the vehicle, probable cause allowed the officer to look inside, discovering a gun in the glove compartment. Information received indicated that Dillard did not own the vehicle nor was the gun registered in his name. However, the defendant was in the vehicle when the weapon was not in sight.
Under the agreement, Dillard received a 90-day sentence with 80 days suspended (10 days to serve).
