Charles City man pleads guilty to unlawfully wounding brother

A Charles City man will spend no active time incarcerated after pleading down to a lesser felony charge.

Kenneth Marvin Wallace, 65, of the 17000 block of The Glebe Lane, entered a guilty plea to an amended charge of unlawful wounding (originally malicious wounding) as part of an agreement reached Monday afternoon in Charles City Circuit Court.

In a summary of evidence, on May 27 Charles City deputies responded to a call for service for a residence on The Glebe Lane where two individuals were fighting with weapons. Upon arriving, a deputy intervened and questioned a witness about the situation. The witness said that Wallace was twirling a 10-inch cast iron frying pan and when she called for assistance, the defendant struck and hit the victim, Larry Wallace with the frying pan. The victim in self defense pulled out a firearm and shot the defendant. According to Charles City Assistant Commonwealth’s Attorney Tyler Klink, evidence presented at the trial would have shown that the victim displayed a knife and firearm to Kenneth Wallace, believing a scintilla of evidence would have existed in order to prove the jury with a self-defense instruction.

Under the agreement, Kenneth Wallace received a five-year sentence with all time suspended.
