Providence Forge woman enters Alford Plea to drug possession

A Providence Forge woman has entered an Alford Plea of Guilt to a July 3, 2022 incident in New Kent County.

Kelly Marie Fuqua, 48, of the 11000 block of Green Oak Road, entered the plea to one count of possession of a Schedule I/II drug during Monday morning proceedings in New Kent Circuit Court. An Alford Plea indicates that while the defendant maintains her innocence, evidence presented in the case would be enough to convict her of the offense.

In a summary of evidence provided by New Kent County Commonwealth’s Attorney Scott Renick, a New Kent deputy patrolling traffic on Route 60 eastbound noticed a four-door truck traveling at a high rate of speed. The officer ran the license plate, with information revealing that the driver of the truck was wanted. After a traffic stop, the driver was arrested, and the passenger, later identified as Fuqua, stepped out of the vehicle and was questioned. During the questioning, Fuqua told the officers she had a smoking device in her purse. That device was sent to the forensics lab, with the results from the test revealing the substance was methamphetamine.

Under the plea agreement, Fuqua received a five-year sentence with all but one day suspended. She must also pay a fine of $500.

In an unrelated case, a Greenwood man will spend four months in jail for possessing methamphetamine.

Harvey Lee Garrison, 36, of the 6300 block of Landon Wood Way, entered guilty pleas to one count of possession of a Schedule I/II substance and misdemeanor violating pretrial conditions as part of a plea agreement. One charge of distributing a Schedule I/II drug was dismissed.

Garrison received a five-year sentence with four years, eight months suspended (four months to serve) on the felony conviction. He must also serve 10 days in jail for violating conditions of his pretrial release.
